Prosecutors Indict Former FBI Leaders Over Laptop Testimony
US Attorney Jeanine Pirro alleges two former executives misled Congress in 2023, citing a new affidavit that details their communications regarding the Hunter Biden investigation.

The Justice Department has formally charged two former FBI executives with perjury related to their 2023 congressional testimony.
Prosecutors allege that Nikki Floris, a former intelligence analyst, and Bradley Benavides, a former deputy assistant director, concealed the extent of their involvement in the Hunter Biden laptop probe. Each defendant faces a maximum sentence of five years in prison. They were released on bail following a brief court appearance on Friday morning.
The case rests on specific discrepancies between the defendants' sworn statements and their internal communications. An FBI affidavit states that Floris claimed she had no knowledge of the laptop while coordinating the bureau's response to media reports in real time. The document further asserts she maintained frequent contact with the case team for over a year. Benavides told the House Judiciary Committee he learned of the device from a Wikipedia entry. Prosecutors say he was actually in constant communication about the matter over several days.
US Attorney Jeanine Pirro stated that the pair undermined the institutions they swore to protect. She argued that when senior agents believe they are above the law, it is time to bring the hammer of justice down on them. A committee member noted that the false answers influenced the investigation by thwarting follow-up interviews and subpoenas.
Defense attorneys for both officials rejected the timing and substance of the charges. Floris's legal team described her as a patriot with nearly 20 years of service and accused prosecutors of filing nonsense charges on the eve of an election. Ron Safer, representing Benavides, urged the court to examine whether the government possessed sufficient evidence against two lifetime public servants.
US Magistrate Judge Zia M. Faruqui questioned why the charges were brought more than three years after the initial testimony. He granted a defense request for an evidentiary hearing scheduled for Tuesday, a timeline he described as rare for defendants released on bail. Faruqui noted that the information appeared quite old and acknowledged the defendants' sparkling backgrounds in law enforcement.
The laptop was handed to the FBI in 2019 by a computer shop owner who said Hunter Biden left it unclaimed. The device remains a partisan flashpoint, with Republicans citing it as evidence of corruption and Democrats characterizing it as a conspiracy. The indictment arrives as many FBI agents accused by Trump allies of working against him have left the bureau since the start of his second term.
